Certain features of the Service require payment. All fees are stated in US dollars unless otherwise specified. Payment is processed through our third-party payment processor.

All fees are non-refundable unless otherwise stated in our refund policy or required by applicable law.

  1. REFUND POLICY FOR DIGITAL CONTENT

    1. Finality of Access and Download

    All sales of digital text, audio, articles, audiobooks, and media feeds (collectively, "Digital Content") are final and strictly non-refundable. Because access to written or audio material is granted instantly upon successful payment, the item is considered fully consumed. We do not offer refunds or exchanges for a change of mind, personal taste, or if you simply do not like the content.

    1. Third-Party vs. Company-Owned Content This strict "No Refunds" policy applies universally to all Digital Content hosted on our platform, regardless of its origin:

      • Company-Owned Content: Materials produced directly by our brand are subject to these final sale conditions.
      • Third-Party Content: For content licensed from external creators, independent writers, or third-party audio producers, we act strictly as a distribution marketplace. We are contractually prohibited from issuing refunds on third-party intellectual property once access or stream metadata has been initiated.

    2. Technical Malfunctions The sole exception to this policy is a verified, catastrophic technical defect (e.g., a corrupt audio file, a completely unreadable text file, or a broken delivery stream). If you experience a playback or viewing failure:

      • You must notify support@lingobits.org within seven (7) business days of purchase.
      • The issue must be reproducible on our end and unrelated to your personal internet connection, device incompatibility, or local hardware constraints.
      • We reserve the right to patch, replace, or repair the file structure within forty-eight (48) hours before any alternative remedy or store credit is evaluated.

    3. Mandatory Waiver of European and UK Consumer Rights

    If you reside within the European Union or the United Kingdom, you acknowledge that under applicable consumer protection frameworks, your standard 14-day "cooling-off" period for online purchases does not apply to digital content streams or instant downloads. By finalizing your checkout and initiating consumption of any text or audio, you explicitly grant us permission to provide immediate performance of your contract, and you acknowledge that you permanently waive your statutory right of withdrawal.

  2. INTELLECTUAL PROPERTY

The Service and its original content, features, and functionality are owned by The Language Collection LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

  1. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LANGUAGE COLLECTION LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

  1. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

  1. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Maine, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Maine.

  1. TERMINATION

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

  1. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the "Effective Date." Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
